Agreement to Terms
By accessing and using the services provided by DEM Des Moines Masonry, you agree to be bound by these Terms of Service. These terms apply to all visitors, users, and others who access or use our services. If you disagree with any part of these terms, you may not access our services.
Services Provided
DEM Des Moines Masonry provides professional masonry services including but not limited to brick repair, chimney rebuilding, tuckpointing, stone patio installation, retaining wall construction, and other related masonry work. All services are subject to availability and provided in accordance with applicable local building codes and regulations in Des Moines, Iowa and surrounding service areas.
Estimates and Pricing
We provide free on-site consultations and written estimates for all projects. Estimates are valid for 30 days from the date of issue unless otherwise noted. Final pricing may vary from the initial estimate if project scope changes, unforeseen conditions are discovered, or if you request additional work beyond the original scope. Any changes to pricing will be communicated and approved by you in writing before work proceeds.
Payment Terms
Payment terms will be outlined in your service agreement. Typically, we require a deposit before work begins, with the balance due upon completion. We accept cash, check, and major credit cards. Late payments may be subject to interest charges as permitted by Iowa law. We reserve the right to place a mechanic's lien on your property for unpaid balances.
Project Timelines
We provide estimated completion dates for all projects. While we make every effort to complete work on schedule, timelines may be affected by weather conditions, material availability, unforeseen site conditions, or changes to project scope. We will communicate any delays promptly and work to minimize disruptions to your schedule.
Warranty and Guarantees
We stand behind the quality of our workmanship and provide warranties on our services as outlined in your service agreement. Warranties typically cover defects in workmanship but do not cover damage resulting from natural disasters, accidents, improper maintenance, or normal wear and tear. Material warranties are provided by manufacturers and are subject to their terms and conditions.
Property Access and Safety
You agree to provide reasonable access to your property for our crew and equipment during the project. We will make reasonable efforts to protect your property and landscaping during work. You are responsible for securing pets and ensuring that work areas are clear of personal belongings. We maintain comprehensive liability insurance and workers compensation coverage for your protection.
Permits and Approvals
For projects requiring building permits, we will typically handle permit applications as part of our service. However, you are ultimately responsible for ensuring that all necessary permits are obtained and that work complies with local regulations, homeowner association rules, and other applicable requirements. Additional fees may apply for permit services.
Cancellation Policy
You may cancel a scheduled project with written notice. Cancellations made more than 7 days before the scheduled start date will receive a full refund of any deposit, minus any costs already incurred for materials or permits. Cancellations made less than 7 days before the start date may forfeit all or part of the deposit. Once work has begun, cancellation terms will be based on work completed and materials purchased.
Limitation of Liability
Our liability for any claim arising from our services is limited to the amount paid for those services. We are not liable for indirect, incidental, or consequential damages. This limitation applies to the fullest extent permitted by Iowa law. Our insurance coverage provides additional protection for property damage and injuries as outlined in our policy.
Dispute Resolution
We are committed to resolving any concerns or disputes amicably. If you have a complaint about our services, please contact us directly so we can address the issue. If we cannot reach a satisfactory resolution, disputes will be resolved through binding arbitration in Polk County, Iowa, in accordance with Iowa law.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website with an updated effective date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. For active projects, the terms in effect at the time of your service agreement will govern.
